In this writ petition the petitioner has challenged the order passed on the 10th November 1981 by the Governor of Tamil Nadu, respondent 1 under Art.192(1) of the Constitution, published in Gazette S. O. M. S. No. 2026 of the even date, disqualifying the petitioner from continuing as a Member of the Tamil Nadu Legislative Assembly, as he has incurred disqualification under Art.191(1)(d) of the Constitution on his assumption of charge of the office of the Honorary Consul General of Turkey at Madras on the 29th October 1980.

2. Mr. Justice Ramanujam, while admitting the writ petition, referred it to a Full Bench in view of the importance of the question that fell for consideration in this writ application, and that is how this matter is before us.

3. The facts necessary for the disposal of this writ petition lie in a narrow compass. The petitioner was elected to the Tamil Nadu Legislative Assembly from the Thiruvallikkeni constituency in the general election held in May 1980, and was duly sworn as a Member of the Assembly in June 1980. He was appointed as Honorary Consul General of Turkey at Madras, after approval of the Government of India, given on the
