The Sole Accused/Appellant Balusamy was convicted for offence under Section 341 of Indian Penal Code and was sentenced to undergo one month Simple Imprisonment, convicted for offence under Section 302 IPC and was sentenced to undergo Imprisonment for Life and to pay a fine of Rs.50,000/-, in default, to undergo Rigorous Imprisonment for three years and convicted for offence under Section 506(ii) (3 counts) and was sentenced to undergo Rigorous Imprisonment for three years and to pay a fine of Rs.5,000/-, in default, to undergo Rigorous Imprisonment for six months for each count. Challenging the judgment of conviction and sentence passed by the Trial Court, the appellant/accused has preferred the present appeal.
2. On the side of the prosecution, twelve witnesses were examined and nineteen documents and seventeen material objects were marked. Neither oral nor documentary evidence was let in on the side of defence.
3. The sum and substance of the prosecution case, as unfolded by the witnesses, reads as follows:-
PW.1 Karunanidhi is the yonger brother of deceased Rajamanickam and PW.4 Sathyabama is the wife of Rajamanickam.
