1. Petitioner, who is a practicing Advocate, has come up with this Writ Petition seeking issue of a Writ of Quo Warranto and to direct the Respondents to show cause under what authority the Fourth Respondent is functioning as the Government Advocate (Criminal Side) of Madras High Court.
2. Heard Mr. Manikandan Vathan Chettiar, learned Counsel for the Petitioner and P.S. Raman, learned Advocate General, appearing on behalf of Respondents 1 and 2 and being assisted by R. Anitha, learned Additional Government Pleader.
3. Thesum and substance of the grievance of the Petitioner as reflected in the affidavit in support of this Writ Petition is that in a few Criminal Original Petitions filed either on behalf of the Petitioner or by the Petitioner on behalf of her clients, the Fourth Respondent took notice for the prosecution and made misrepresentations. Thereafter, when the truth got exposed, Tamil Nadu Information Commission imposed a penalty of Rs. 25,000/- on the Deputy Commission of Police and that in order to avoid the consequence of such a penalty, the police started harassing the Petitioner and prevented her from discharging the duties of an Advocate towards her clients.
