IN THE HIGH COURT OF JUDICATURE AT MADRAS
Mr. Justice Balakrishna Ayyar, J.
S.O. Krishna Aiyar.
Versus
S.V. Narayanan alias S.V. Doraiswami.
C.R.P.No. 532 of 1949.
Decided On : 21 September 1950
Advocates:
S. Ramachandra Aiyar for Petitioner.
R. Desikan for Respondents.
Scope of the provisions of Order 471.
Headnote:Code of Civil Procedure, 1908-Order 47, Rule 1 - Scope of the order.
Judgment.-
What the learned Judge has really done is to write a second judgment reversing his first because on fuller argument and further consideration he thought that the view he had first taken was wrong. This is clearly not a purpose for which Order 47(1) is intended. This petition is allowed with costs and the proceedings of the Court below under the power of review which it supposed it had are set aside.
V.S. ----- Petition allowed.
