On 11.01.2012, when the matter came up for hearing, again there has been no representation on the side of the Appellant and the matter has been directed to be listed under the caption for dismissal on 12.01.2012. Accordingly, the matter has been listed today. Till about 1.00 pm, there is no representation on the side of the Appellant.

Hence, the Second Appeal is dismissed for want of diligence. No costs. Consequently, connected C.M.P.No.9094 of 1999 is closed.
