1. This Civil Revision Petition has been preferred under Section 25 of the Tamil Nadu Buildings (Lease and Rent Control) Act 1960 as amended by Act 23 of 1973 and Act 1 of 1980 against the judgment and decree dated 19.06.2009 passed by the learned Appellate authority (the VII Judge, Court of Small Causes at Madras) in R.C.A.No.958 of 2006 dismissing the appeal and confirming the judgment and decree dated 25.07.2006 passed by the learned Rent Controller (the X Judge, Court of Small Causes at Madras) passed in R.C.O.P.No.2390 of 2005.
2. In the petition filed by the landlord, it is stated as follows:-
2.1. The petitioner / landlord is the absolute owner of the property in question. The said property was purchased from one Rajammal by a registered sale deed dated 05.07.1996. Originally, the respondent is a tenant under the said Rajammal, who is the vendor of the petitioner and the respondent was carrying on business under the name and style of “Chenbagambigal Coffee” in the petition premises. After the date of purchase, her vendor, the said Rajammal attorned the tenancy of the respondent herein in favour of the petitioner.
