JUDGMENT:-

1. This Civil Revision filed under Article 227 of the Constitution challenges the dismissal of an application filed by the defendant in a suit for recovery of possession, for the issue of a subpoena to the Director of Forensic Sciences to compare the handwriting and signatures in the disputed and admitted documents namely Exhibits B22 to B26 with Exhibits B2 to B21.

2. I have heard Mr.AR.L.Sundaresan, learned Senior Counsel for the Petitioner and Mr.N.R.Chandran, learned Senior Counsel for the Respondent.

3. There is no dispute about the fact that the respondent herein is the owner of the house bearing Old Door No.40, New Door No.14, Venkatesan Street, T.Nagar, Chennai-17. Contending that the respondent had agreed to sell the suit property to him under an agreement dated 10.1.1994 and also received a total amount of Rs.33,00,000/- during the period from 10.1.1994 to 23.6.1994 and also put him in possession, the petitioner herein filed a suit in O.S.No.6514 of 2002 on the file of the XI Assistant Judge, City Civil Court, Chennai, for a permanent injunction restraining
