The relief sought for in this writ petition is to call for the records in relation to the impugned order passed by the 3rd respondent in proceedings dated 01.03.2017 and consequential order of recovery passed by the 5th respondent in proceedings dated 04.04.2017 and quash the same and direct the respondents to sanction incentive increment for passing M.Phil in Physical Education to the petitioner as per G.O.M.S.No.324, Education, Science and Technology Department dated 25.04.1995.

2. The learned counsel for the writ petitioner states that, the writ petitioner was appointed as Physical Education Teacher in government Higher Secondary School. His services were regularized subsequently and he had completed his probation also on 31.05.2008.

3. The grievances of the writ petitioner is that he passed the M.Phil degree in Physical Education and therefore, he is entitled for incentive increment as per the Government orders for possessing higher educational qualifications.
