JUDGMENT :

1. Challenge in this second appeal is made to the judgment and decree dated 07.03.2015 passed in A.S.No.29 of 2014 on the file of the IV Additional Subordinate Court, Coimbatore reversing the judgment and decree dated 04.03.2014 passed in O.S.No.2123 of 2010 on the file of the Principal District Munsif Court, Coimbatore.

2. The parties are referred to as per the rankings in the trial court.

3. Suit for permanent injunction.

4. The case of the plaintiff in brief is that the plaintiff and the defendant are brothers and the suit properties and the other properties originally belonged to father of the plaintiff and the defendant namely Anganna Gounder and during his life time, the suit properties and other properties were partitioned amongst Anganna Gounder and his four sons including the plaintiff and the defendant by way of a registered partition deed dated 10.12.1982 and in the said partition, the first schedule was allotted to the plaintiff's share and he is in possession and enjoyment of the same as the absolute owner of the properties comprised in the said schedule and the patta had also been issued in favour of the plaintiff in respect of the suit property and furthermore
