Prayer: First Appeal has been filed under Section 96 of the Civil Procedure Code against the Judgment and Decree dated 30.12.2011 passed in O.S.No.2488 of 2011 on the file of the Fast Track Judge-III, Additional District Court, Chennai.

1. Aggrieved over the Judgment and Decree dated 30.12.2011 passed in O.S.No.2488 of 2011 on the file of the Fast Track Judge-III, Additional District Court, Chennai, the plaintiff has preferred the first appeal.

2. For the sake of convenience, the parties are referred to as per their rankings in the trial Court.

3. Suit for specific performance and declaration.

The case of the plaintiff in brief is that the first defendant is the owner of the property bearing Old No.4, New No.5 & 6, Madhavaram High Road, Perambur, Chennai -1 and the first defendant had appointed the second defendant as her lawfully constituted power of attorney agent to deal with the abovesaid property including the right to sell the same to the prospective purchasers. The power of attorney was executed by the first defendant in favour of the second defendant on 15.07.2002 and the same has been registered.
