JUDGMENT :

SUBRAMONIUM PRASAD, J.

Prayer: Petition filed under Article 226 of the Constitution of India praying for the issuance of a writ of certiorarified mandamus, to call for the records pertaining to the charge memo issued by the respondent herein in his Letter No. 12558/E1/2009-12 dated 13.3.2014 and quash the same and consequently direct the respondent herein to promote the petitioner as Assistant Executive Engineer and Executive Engineer, on par with juniors with all consequential service and monetary benefits.

1. Instant writ petition has been filed, to quash the charge memo, issued by the Secretary to Government, Public Works Department, Secretariat, respondent, in Letter No. 12558/E1/2009-12, dated 13.3.2014 and consequently, direct the respondent, to promote the petitioner, as Assistant Executive Engineer and Executive Engineer, on par with juniors, with all consequential service and monetary benefits.

2. Facts in brief are as follows:-

Government of Tamil Nadu, in G.O.Ms. No. 1926, Public Works Department, dated 2.12.1988, accorded administrative sanction, for Rs. 1012 lakhs, for the formation of Reservoir across Nambiyar river, near Kottaikarungulam Village, in Radhapuram
