JUDGMENT :

(Prayer: Writ Petition filed under Article 226 of the Constitution of India praying this Court to issue a writ of certiorarified mandamus to call for the records on the file of the 1st respondent relating to the order in G.O. (2D) No.105, Commercial Taxes and Registration (H) Department, dated 5.8.2013, quash the same and to issue consequential directions to the respondents to regularise the period of suspension from 13.3.08 to 29.2.08 as ‘duty’ for all purposes and declare that the petitioner shall be deemed to have been reinstated in service on 13.2.08 and retired from service on 29.2.08 without any condition and with all pensionary and retirement benefits.)

1. It is the case of the petitioner that he entered the service of the 2nd respondent as Junior Assistant and after obtaining a series of promotions, at the crucial point of time, was functioning as District Registrar and the petitioner, on attaining the age of superannuation, was due to retire from service on 29.2.08. While serving thus, vide G.O.
