Original Side Rules - Order XXV Rule 6 - Indian Succession Act, 1925 - Section 372 - Legal Heirs - Grant of Succession Certificate - Unclaimed Dividends- Petitioners are Class-1 legal heirs of deceased claimed to be entitled to equal share in Shares and Dividends held in ITC Limited, Registered Office at “Virginia House”, which are in the name of deceased - Original Petition is filed to grant Succession Certificate to 1st petitioner, with power to collect Securities and to receive unclaimed Dividends thereon and negotiate and transfer the securities specified in the Schedule - Held, Considering the averments made in the petition and the documents filed by petitioners, this Court is satisfied that petitioners have succeeded Estate of deceased - Therefore, petition is ordered as prayed for and a direction is issued to Registry, for grant of Succession Certificate to first petitioner with power to collect Securities and to receive unclaimed Dividends thereon and negotiate and transfer securities specified in schedule hereto - First petitioner is directed to render accounts once a year - Order accordingly.

JUDGMENT :

(Prayer: Original Petition (O.P) filed under Section 372 of the Indian Succession Act, 1925, read with Order XXV Rule 6 of the Original Side Rules of this Court, praying that Succession Certificate may be granted to the first petitioner with power to collect the securities and to receive unclaimed Dividends thereon and negotiate and transfer the securities specified in the Schedule hereto.

1. This Original Petition is filed to grant Succession Certificate to the 1st petitioner, with power to collect the Securities and to receive unclaimed Dividends thereon and negotiate and transfer the securities specified in the Schedule.

2. The petitioners have averred as follows in the petition:

    (a) The petitioners are the Class-1 legal heirs of the deceased Mr.S.Babulal claimed to be entitled to equal share in the Shares and Dividends held in ITC Limited, Registered Office at “Virginia House”, at No.37, J.L.Nehru Road, Kolkata-700 071, which are in the name of the deceased Mr.S.Babulal (mentioned as Sha Babulal S.Jain in Share Certificates). The distinctive number of shares mentioned herein below are being transferred to the IEPF (Investors Education and Protection Fund) Account, operated and maintained in the Company. There are also some bonus Shares issued by the company with the Distinctive No’s.3904521003 to 3904530392 (transferred to IEPF Account) and 8101843211 to 8101852600 (Held in Company) and it has been admitted by the company in their email dated 12.09.2020 and letter correspondence dated 28.10.2020 and 19.11.2020.
