JUDGMENT :

(Prayer: Writ Petition is filed under Article 226 of the Constitution of India, praying for the issuance of a Writ of Certiorarified Mandamus, calling for the records of the first respondent in his proceedings in Na.Ka.A3/592/2011 dated 08.10.2011 and the consequential auction notice of the second respondent in Na.Ka.A4/2837/2010 dated 14.12.2011 in so far as it pertains to the petitioner and quash the same and to forbear the respondents from interfering with the petitioner’s right in respect of the two Eris located in Veperi Village, Arakkonam Taluk, Vellore District.)

1. The order dated 14.12.2011 notifying the public auction and another order dated 08.10.2011 are under challenge in the present writ petition.

2. The 08.10.2011 order was passed based on G.O.Ms.No.169, Rural Development Department, dated 16.08.1999. The said Government Order deals with the Tamil Nadu Panchayats (Lease and Licensing of Fishery Rights in Water Sources vested and regulated by Village Panchayats and Panchayat Union Councils) Rules, 1999.

3. The Rules are not under challenge in the present writ petition. The order dated 08.10.2011 passed in consonance with the abovesaid Government Order states th
