1. In both the writ petitions since common question is involved, same is being decided by a common order. In W.P. (C) No. 10433 of 2005 the New India Assurance Company Limited through its Branch Manager has filed this writ petition, case is that claimant Mukta Jani while working as labourer in the truck bearing Registration No. OR-01-2160 belonging to the opposite party No. 1, had died on 3.11.1999 in course of his employment. Pursuant to notice owner of the vehicle entered appearance and filed written statement. Insurer of the vehicle i.e. the petitioner has filed written statement denying liability. Learned Commissioner for Workmen's Compensation and Assistant Labour Commissioner, Jeypore in W.C. No. 58 of 1999 after taking into facts and circumstances of the case vide order dated 20.7.2002 awarded amount of Rs. 1,01,213/- and directed the present petitioner to pay the same within 60 days from the date of passing of the order failing which the petitioner would be liable to pay interest under section 4-A of the Workmen's Compensation Act, 1923.
