JUDGMENT

1. The instant Intra Court Appeal is directed against the order dated 10.11.2022 passed by the learned Single Judge, whereby the Appellant/Petitioner has been relegated to seek her remedy before the DRT, Odisha, Cuttack.

2. Heard learned counsel for the Appellant.

3. It is not in dispute that the Petitioner had raised a loan of Rs.30 lakhs from Bank of Baroda, Angul Branch, Angul on 20.12.2018, to be repayable in 84 EMI's. This is also not in dispute that for the non-deposit of due installments, the loan account was declared NPA on 29. 10.2020. It is stated that the hypothecated Truck was seized on 24.03.2022 at the behest of the Bank in violation of the directions passed by the Hon'ble Supreme Court in ICICI Bank Ltd. Vs. Prakash Kaur and Others (2007) 2 SCC 711. However, for the said incident the criminal complaint filed with the Police Station, Angul was not converted into FIR. It is also not disputed that the petitioner for redressal of his grievance has already approached the District Consumer Dispute Redressal Commission, Angul since 28.03.2022 and also has an interim order in his favour in respect of non-seizure of the said vehicle.
