PUNJAB & HARYANA HIGH COURT
R.P.Sethi and Swatanter Kumar JJ.
Punjab State Medical Dental Teachers Association
Versus
State Of Punjab
Civil Writ Petition No. 16029 of 1993,
Civil Misc. No. 1181 of 1994,11358 of 1994,
Decided On : JANUARY 12, 1996

Reservation policies of the States, wherever in existence, shall continue to be in force for a period of five years from the date of the judgment in Indra Sawhney etc. vs. Union of India and others, AIR 1993 Supreme Court 477.

Headnote:

RESERVATION POLICY - TEACHING AND RESEARCH POSTS - APPLICABILITY - PUNJAB MEDICAL EDUCATION SERVICES (CLASS I) RULES, 1978 - PUNJAB MEDICAL EDUCATION SERVICE (CLASS II) RULES, 1979 - ARTICLES 16(4), 335 OF THE CONSTITUTION OF INDIA.

Fact of the Case:

The petitioner, a medical teacher, challenged the reservation policy of the State of Punjab for Scheduled Castes and Backward Classes in all State services, including medical colleges, arguing that it violated Article 16(4) read with Article 335 of the Constitution of India.

Finding of the Court:

The court held that the reservation policy was constitutionally valid and legally permissible, and that the petitioner was not entitled to any relief under Article 226 of the Constitution.

Issues: 1. Whether the reservation policy of the State of Punjab for Scheduled Castes and Backward Classes in all State services, including medical colleges, was constitutionally valid and legally permissible? 2. Whether the petitioner, a medical teacher, was entitled to any relief under Article 226 of the Constitution?

Ratio Decidendi: 1. The court relied on the Supreme Court's decision in Indra Sawhney etc. vs. Union of India and others, AIR 1993 Supreme Court 477, which held that reservation was not permissible in the matters of promotion, but that wherever reservations exist, such reservations may continue in operation for a period of five years from the date of the judgment. 2. The court also held that the petitioner was not engaged in any research work, as defined in the State's instructions dated September 2, 1975, and therefore the reservation policy was not applicable to him.

Final Decision: The court dismissed the writ petition, holding that the reservation policy was constitutionally valid and legally permissible, and that the petitioner was not entitled to any relief under Article 226 of the Constitution.
