1. This writ petition under Article 226 of the Constitution of India has arisen out of the following facts:

2. K.G. Pillai petitioner started his career as an Upper Division Clerk in the office of the Comptroller, Vindhya Pradesh, Rewa, on 1st September, 1953. As a result of the re-organisation of the States in India, he was transferred to the office of the Accountant General, Madhya Pradesh, Gwalior, in the same capacity in the year 1957. He continued to discharge his duties as such to the satisfaction of all concerned till November, 1959, when he was allowed to cross his efficiency bar. Thereafter the Deputy Accountant General, Madhya Pradesh, Gwalior, on the 5th March, 1960, wrote him a letter that the Department intended initiating disciplinary proceedings against him under the Central Civil Services (Classification, Control and Appeal) Rules, 1957. The charges on which he was to be tried with the statement of allegations were duly served on him. These form annexurs 1 to the petition. The charges were to the effect that he did not comply with the posting orders issued to him by the competent authority and that he absented himself from duty without leave f
