2006 Supreme(P&H) 1792

P.S.PATWALIA, JAGDISH SINGH KHEHAR
Nayyar Bus Service Regd. – Appellant
Versus
Secretary, Regional Transport Authority, Jalandhar – Respondent

Judgment

J. S. Khehar, J.

1. Through the instant writ petition, the petitioner has sought the issuance of a writ in the nature of mandamus, requiring respondent no.1 to take a final decision on the legal notice dated 11.8.2005 (Annexure p2)wherein the petitioner has prayed for stopping the illegal operation of buses without valid permits. Notice of motion.

2. On our asking, Mr. Ashok Aggarwal, Additional Advocate general Punjab, accepts notice on behalf of the respondents. Learned counsel for the respondents states that he has no objection to the disposal of the instant writ petition in terms of the prayer made by learned counsel for the petitioner.

3. In view of the above, we consider it just and appropriate to dispose of the instant writ petition by directing respondent No.1 i. e. the secretary, Regional Transport Authority, Jalandhar, to take a final decision on the legal notice dated 11.8.2005 (Annexure P2), by passing a well reasoned speaking order within one month from the date of receipt of a certified copy of this order. Disposed of accordingly.

4. Order dasti on payment of usual charges.
