Judgment

1. Heard. OFFENCE alleged is under section 3 (1) (X) of SC and ST (POA)Act and sections 323/506 IPC. It is submitted that FIR was lodged by one Nirmal Singh and santokh Singh against Kanwaljit Singh etc. , who were a rival faction and respondent No.2 filed a complaint alleging that he was abused in the name of his caste, as a counter-blast.

2. It is further submitted that the DSP, in his enquiry, found that the version of respondent No.2 was false. It is pointed out that in these circumstances, as held in Om Parkash Sharma vs. Union Territory, chandigarh, 2001 (3) RCR (Crl.) 840 and Pishora Singh vs. State of punjab, 2002 (2) RCR (Crl.) 215, the petitioners ought to be granted bail and they will face proceedings in accordance with law. Without expressing any opinion on merits, a direction is issued that on filing of regular bail application, the petitioners will be granted bail by the trial court, on appropriate conditions. The petition is disposed of.
