Judgment

H. S. Rai, J.

1. This is a petition under Sec.482 Cr. P. C. for quashing F. I. R. No.53 dated 18-4-1987 under Sec.498-A and 406 I P. C. Police Station Dirba.

2. The prayer of the counsel for the petitioners is that as the parties have compromised and all disputes between them have amicably been settled, there is no chance of a conviction even if the matter is pursued in Courts of law. He has prayed that in such a situation it will be in the interest of the parties and society if the parties are allowed to be free of their matrimonial disputes at the earliest so that they both may settle in life.

3. Mr. Ashok Bhan, learned counsel for the complainant has stated that parties have compromised and his client is not to pursue the case and has also prayed that the F. I. R. be quashed so that his client is also free of the tension.

4. Mr. Saron, learned AAG, has submitted that simply the fact that parties have compromised may not be a ground for quashing the F. I. R.

5. I have considered the submissions. In the peculiar circumstances of the case as parties have compromised and there is no chance of ultimate conviction, F. I. R. No.53, dated 18-4-1987 under Sec.498 and 406 I. P. C.
