A.N.Jindal, J.: Mohinder Singh and his sons Sharma Singh, Dalbir Singh, Kashmir Singh, and Kulwant Singh faced trial under Sections 302, 307,326,325,148 read with Section 149 of the Indian Penal Code (hereinafter referred to as ‘IPC’) for murder of Hira Singh and causing injuries to Kala Singh and Piara Singh on the night of 21.6.2003 in the area of village Fatehabad Khurd Police Station Ajnala. Consequently, vide judgment dated December 20, 2004 they were convicted for the aforesaid offences and were sentenced as under:-
Under Sections 302/149 : Dalbir Singh accused was sentenced under Section 302 IPC and the other accused under Sections 302/149 IPC to undergo rigorous imprisonment for life and to pay a fine of Rs.2000/- each. In default of payment of fine to further undergo rigorous imprisonment for six months each.
U/s 148 IPC : All the accused were sentenced to undergo rigorous imprisonment for one year.
U/s 307/149 IPC : Sharma Singh accused was sentenced under sections 307 IPC and the remaining accused under Section 307/149 IPC to undergo rigorous imprisonment for five years and to pay fine of Rs.1000/-each. In default of payment of fine to further undergo rigorous
