JUDGMENT

Mr. Rakesh Kumar Garg, J.: (Oral) - Petitioner was declared as Proclaimed Offender in FIR No.271 dated 05.09.2007 under Sections 341, 323, 452, 427, 506, 148 and 149 IPC registered at P.S.Nakodar, District Jalandhar, vide order dated 24.01.2011.

2. The said order has been challenged by the petitioner and it has been submitted in this petition that initially the petitioner was arrested in the FIR in question and was released on furnishing of bail bonds. Thereafter, he continued to appear before the trial Court for a period of more than 2½ years and there was a mutual compromise between the parties on 23.10.2010 and thereafter, the parties filed petitions i.e. CRM No.M-36299 of 2010 (O&M) and CRM No.M- 33720 of 2010 (O&M) under Section 482 Cr.P.C. for quashing of the FIR. Since in between the petitioner failed to present before the Court, he was declared as Proclaimed Offender. Petitioner through his counsel prayed for staying the proceedings of trial Court in the aforesaid quashing petition. However, this Court refused to exercise the discretion in his favour. Thereafter, petitioner filed an application under Section 438 Cr.P.C. for grant of anticipatory bail before the Ses
