JUDGMENT

Mr. Alok Singh, J. (Oral): - This is an application under Section 439 Cr.P.C. seeking regular bail in a case FIR No. 24 dated 15.2.2010 under Sections 419/420/465/467/468/471/120-B IPC registered at Police Station Ajnala, District Amritsar.

2. Learned counsel for the petitioner has argued that only allegation against the petitioner is that he in connivance with the other co-accused has prepared a forged Power of Attorney allegedly executed by Bir Kaur and has sold the land of Bir Kaur in favour of Gurpreet Singh and Jarnail Singh. Learned counsel for the petitioner has further argued that every document is now on the record and there is no chance of tempering with the evidence. He has further argued that petitioner is in judicial custody w.e.f. 9.7.2010.

3. Mr. Kirat Singh Sidhu, DAG Punjab on the instructions of ASI Baldev Singh has stated that challan has already been presented before the trial Court and charges are yet to be framed.

Considering totality of the facts and circumstances of the case, petition is allowed. Let the petitioner be released on bail to the satisfaction of the trial Court.
