K.K. Srivastava, J. - This is an appeal against the conviction under Section 376 of the Indian Penal Code and sentence of 5 years rigorous imprisonment besides fine of Rs. 1,000/- each and in default of suffer further rigorous imprisonment for three months, ordered by the learned Additional Sessions Judge, Sangrur, vide his judgment dated 30.3.1995. The two appellants, Sat Pal and Pala were tried in Court of Shri D.S. Chatha, the then Additional Sessions Judge, Sangrur in Sessions Case No. 55/30-7-1992, Sessions Trial No. 26/3.2.1993, on the charges punishable under Section 376 Indian Penal Code and Section 506, read with Section 34 Indian Penal Code.

Pritam Kaur (PW 1), wife of Bant Singh (PW 4) left her house situated in village Samrao Pati Chhajli, within the limits of police station Sunam, District Sangrur on 15.12.1991 with her two minor children, one year old son and a daughter aged around 2-1/2 year, to visit her sisters house in village Namol.
