ORDER

K.S. Garewal, J. - The appellant is seeking suspension of sentence and release on bail solely on the ground that he has been continuously in custody since September 25, 1996. He was convicted under Sections 304-B and 498-A Indian Penal Code on January 31, 2000 and has filed criminal Appeal 281 of 2000, which is not likely to be heard in the near future.

2. The appellant relies on the decision of the Honble Supreme Court in 1999(2) RCR (Crl.) 770 (SC). Criminal Appeal No. 594 of 1999 decided on May 12, 1999 (Bhagwan Rama Shinde Gosai v. State of Gujarat).

3. The application is accepted. The appellant is hereby directed to be released on bail to the satisfaction or CJM, Karnal.

Application allowed.
