JUDGMENT

J.S. Khehar, J. (Oral) - CM is allowed.

2. Learned counsel for the parties have made a joint request that the order passed by the Civil Judge, Senior Division, Panchkula dated 27.9.2000, a copy of which has been placed on the record of this case as Annexure P1 be modified to the extent that the petitioner be permitted to take his children on the second Sunday of every month rather than third Sunday of every month as indicated in the order dated 27.9.2000. In view of the joint request made by the learned Counsel for the parties order dated 27.9.2000 is modified to the aforesaid extent.

3. Respondent Nos. 1 and 2 have tendered an unqualified apology for their previous actions and have submitted that in future the children will be allowed to go with their father i.e. the petitioner without any obstruction whatsoever. In the aforesaid view of the matter, it is not considered appropriate to continue with the proceedings of this case any further. Rule issued to the respondents is discharged.

4. Dismissed.

5. No costs.

A copy of this order shall be furnished by respondent No. 1 to the Principal of Dagshai Public School, Dagshai for compliance.

Petition dismissed.
