T.H.B. Chalapathi, J. - This appeal is directed against the conviction and sentence imposed by the learned Additional Sessions Judge, Sirsa in Sessions Case No. 22 of 1987 dated 27.5.1988.
2. The accused-appellant was convicted for the offence under Section 15 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short the N.D.P.S. Act) and sentenced to undergo rigorous imprisonment for a period of ten years and pay a fine of Rs. one lac.
3. According to the case of the prosecution on 30th September, 1996 Head Constable Ram Singh apprehended the accused-appellant near Khuyian Malkana and recovered 2-1/4 Kgs. of poppy straw from the possession of the accused. Thereafter, he sent a ruqa to the Police Station and a formal F.I.R. was registered and after completion of the investigation, a charge-sheet was filed.
4. On the basis of the material placed before him, the learned Additional Sessions Judge committed the case to the Sessions and on committal, the learned Additional Sessions Judge framed a charge against the accused-appellant for the offence under Section 15 of the N.D.P.S. Act and the accused pleaded not guilty to the said offence.
