1. This petition had initially come up for hearing on 18.09.2017 along with CWP No.22983 of 2014 (Sunita Devi vs. State of Haryana & ors.) and CWP No.24437 of 2013 (Kulwinder Singh & ors. vs. State of Haryana & ors.), in which the same issue was involved. On that date, i.e. 18.09.2017, Kulwinder Singh's case was allowed by this Court, with the direction to the respondents to offer him an appointment as a Jail Warder, on the ground that the posts advertised in the category of Ex-Servicemen (ESM), remained unfilled and therefore, those in the waiting list from the General Category/the vertical reservation category in which the horizontal reservation for ex-servicemen had been made, had a right to be appointed in terms of the instructions of Haryana Government dated 04.04.2014.

2. It had been noticed by this Court that the stand of the respondents was that since the selection process in question had started before the issuance of the aforesaid instructions, the petitioner would have no right to appointment in terms of those instructions.
