JUDGMENT

Arvind Singh Sangwan, J. - Prayer in this petition is for quashing of the F.I.R. No. 68 dated 30.06.2009, under Sections 452, 323, 341, 34 I.P.C., registered at Police Station, Kapurthala, as well as the subsequent proceedings including the order dated 16.11.2011 (Annexure P-4), passed by the Chief Judicial Magistrate, Kapurthala, whereby the non-bailable warrants have been issued against the petitioners and later on they were declared proclaimed offender.

2. On 24th July 2018, the following order was passed:

    "Learned counsel for the petitioners submits that after registration of the FIR, the police, during investigation, submitted a cancellation report and, thereafter, the petitioner travelled abroad since they then are living in Australia. It is further submitted that the trial Court instead of accepting the cancellation report, without passing a reasoned order, summoned the petitioners, vide impugned order. Learned counsel for the petitioners submits that two of the co-accused of the petitioners, namely Kulwant Singh and Dharminder Singh, who faced full length trial before the trial Court, have been acquitted, vide judgment dated 03.08.2015 (Annexure P-5) and the case of
