JUDGMENT

Surinder Gupta, J. - Motor Accident Claims Tribunal, Ludhiana (hereinafter referred to as 'the tribunal') vide award dated 23.11.2015 allowed compensation of Rs. 5,19,200/-for death of Gurvir Singh, son of appellants, in a motor vehicle accident with Car bearing registration No. PB-10DU-6369.

2. As the only issue involved in this appeal relates to quantum of compensation as awarded by tribunal, detailed facts of the case are being skipped for the sake of brevity.

3. The compensation awarded by the tribunal was computed as follows:-

(i)

Name of the deceased

Gurvir Singh

(ii)

Age of the deceased

17 years

(iii)

Income of the deceased

Rs. 3900/- p.m.

(iv)

Deduction towards personal expenses %rd

Rs. 3900 – 1300 = Rs. 2600 p.m. i.e. Rs. 31200 p.a.

(v)

Multiplier applied 16

Rs. 31200 x 16 = Rs. 499200/-

(vi)

Funeral expenses and loss of estate

Rs. 20000/-

 

Total

Rs. 5,19,200/-

4. Learned counsel for the appellants has argued that deceased was a young boy, who was working as Carpenter and was earning more
