JUDGMENT

Lisa Gill, J. - This matter is being taken up for hearing through video conferencing due to outbreak of the pandemic, COVID-19.

2. Petitioner seeks concession of bail pending trial in FIR No. 86 dated 09.03.2012, under Section 376, 506, 120-B IPC, Police Station Baldev Nagar, District Ambala.

3. As per allegations in the FIR, the complainant's daughter was allured by the petitioner with a promise to marry and it is alleged that the petitioner committed rape upon the complainant's daughter for three (03) years on this pretext.

4. Learned counsel for the petitioner argues that the alleged victim was 27 years old at the time of the alleged incident and the relationship, if any, between the petitioner and the victim was consensual in nature and there is no question of any element of force involved therein. It is submitted that there are serious discrepancies in the deposition of the victim, who has deposed as PW-1. It is thus prayed that this petition be allowed.

5. I have heard learned counsel for the parties and have gone through the file with their assistance.
