JUDGMENT :

MANJARI NEHRU KAUL, J.

1. Instant petition has been filed under Section 439 Cr.PC for grant of regular bail to the petitioner in case FIR No.383 dated 02.11.2020 registered under Section 22 (C) of NDPS Act, 1985 at Police Station City Mandi Dabwali District Sirsa.

2. Learned counsel for the petitioner inter alia contends that the petitioner has been in custody since 02.11.2020 and only challan has been presented till date. Hence, there is no likelihood of the trial concluding in the near future. He further submits that no doubt the challan was presented within the prescribed statutory period of 180 days, however, it was not accompanied by the FSL Report. Hence, the challan was incomplete entitling the petitioner to the grant of default bail. In support of his submissions, learned counsel for the petitioner has placed reliance on the Division Bench judgment in case of Inderjeet Singh @ Laddi and others vs. State of Punjab, 2014(3) RCR (Crl.) 953.

3. Per contra, learned State counsel while opposing the prayer of learned counsel for the petitioner on instructions from ASI Suresh Kumar has submitted that the petitioner was found in possession of 1000 intoxicating tablets of Tr
