IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH
Arun Kumar Tyagi, J.
Ved Parkash Sharma - Appellant
Versus
State Of UT Chandigarh - Respondent
CRM-M-48569-2019
Decided On : 20-08-2021
Abuse of Process - Criminal Trespass - Indian Penal Code, 1860 - Section 453
Fact of the Case:
The petitioner filed a petition under Section 482 of the Code of Criminal Procedure, 1973 for quashing an FIR registered under Section 453 of the IPC. The dispute involved the ownership and possession of a house in Chandigarh, with conflicting claims based on different wills executed by the deceased owner. The petitioner claimed joint possession with other legal heirs and argued that the FIR was a counter-blast to civil litigation. The complainant alleged that the petitioner trespassed and committed an offence under Section 453 of the IPC.
Finding of the Court:
The court found that the conflicting wills were not duly proved, and in the absence of proof of voluntary execution, the house would devolve by intestate succession on all legal heirs. The court noted that both parties were not in actual physical possession of the house at the time of the alleged trespass. It held that the petitioner's entry was in exercise of a bona fide claim and did not constitute criminal trespass under Section 453 of the IPC.
Issues: The issues involved the conflicting claims of ownership and possession based on different wills, the nature of the dispute, and the validity of the FIR and consequential proceedings.
Ratio Decidendi: The court applied legal principles from judicial precedents to determine the elements of criminal trespass and the exercise of inherent powers under Section 482 of the Cr.P.C. It emphasized the importance of a bona fide claim of right in determining criminal trespass.
Final Decision: The court allowed the petition and quashed the FIR and all consequential proceedings arising from it.
