JUDGMENT

Jasgurpreet Singh Puri, J. (Oral). - The present petition has been filed under Section 438 of the Code of Criminal Procedure for grant of anticipatory bail in FIR No. 136 dated 26.08.2020, under Section 420 IPC and Section 13 of the Punjab Travel Professionals (Regulation) Act, 2014, registered at Police Station Maqsudan, District Jalandhar.

2. As per the FIR, a complaint was lodged against the petitioner and his wife that they had promised the complainant that his son would be facilitated for immigration to United States of America and in lieu of the same, they had received Rs.12 lacs.

3. It is the case of the petitioner that during investigation, the wife of the petitioner has already been declared as innocent by the police and so far as money of Rs.4 lacs which was allegedly transferred to the petitioner, is concerned, the same was, in fact, pertaining to a loan amount because the complainant is a money lender and in fact a false case has been registered against the petitioner.
