Fact of the Case:

Raja Tej Singh Vidyalaya Aurandh, a society running a Junior High School by the same name, held elections for its committee of management on 19/11/1995. Disputes arose among members, leading to multiple elections and submission of different sets of committee members to the Assistant Registrar, Firms, Societies, and Chits (AR) and the Basic Shiksha Adhikari (BSA) for recognition. The BSA recognized Sri Satya Pal Singh as the manager, prompting Sri Lallu Singh, another claimant, to file a writ petition challenging the order. The BSA reaffirmed its decision on reconsideration, leading to another writ petition by Sri Lallu Singh. During the pendency of this petition, the BSA issued an order for single operation of accounts under the U.P. Junior High School (Payment of Salaries of Teachers and other Employees) Act, 1978, based on a letter from the Joint Director of Education (Basic). Sri Satya Pal Singh filed a writ petition against this order, and Sri Lallu Singh filed a writ petition challenging the AR's order recognizing Sri Satya Pal Singh as the manager.

Finding of the Court:

1. The Prescribed Authority under Section 25 of the Societies Registration Act has jurisdiction to decide doubts or disputes regarding elections, continuance in office of office bearers, or dissolution of a society. The Registrar's powers are limited to registering societies, considering objections against registration, canceling registration, applying for dissolution of a society, calling for information from a society, ordering audits, investigating society affairs, calling meetings to hold elections, and deciding objections to the list of governing body members. The Registrar cannot decide election disputes or continuance of office bearers, which falls under the jurisdiction of the Prescribed Authority. 2. The BSA has administrative powers to recognize a committee of management based on factors such as control over funds, administration, and receipt of income. The BSA's decision is subject to statutory determination of the dispute or a decision by a civil court. 3. The decision of the Prescribed Authority under Section 25 of the Societies Registration Act prevails over the decisions of the BSA and the Registrar in matters of election disputes. 4. The Hindu College case, which dealt with an Intermediate College under the Intermediate Education Act, is distinguishable from the present case involving a Basic School under the Societies Registration Act. The provisions and principles governing Intermediate Colleges do not apply to Basic Schools. 5. The AR lacked jurisdiction to decide the dispute between the rival committees of management, as it was cognizable by the Prescribed Authority under Section 25 of the Act. 6. The BSA afforded reasonable opportunity to Sri Lallu Singh to present his case, despite not providing copies of documents relied upon by Sri Satya Pal Singh. 7. The BSA's order for single operation of accounts was illegal as it was passed without affording reasonable opportunity to the committee of management.

Did the BSA afford reasonable opportunity to Sri Lallu Singh before recognizing Sri Satya Pal Singh? 5. Is the order dated 23-10-1999 passed by the BSA, for single operation of accounts, legal?

Ratio Decidendi: 1. The Prescribed Authority under Section 25 of the Societies Registration Act has exclusive jurisdiction to decide election disputes, continuance of office bearers, and dissolution of societies. The Registrar's powers are limited to registration-related matters and cannot encroach upon the jurisdiction of the Prescribed Authority. 2. The BSA's power to recognize a committee of management is administrative and subject to statutory determination or a decision by a civil court. The BSA's decision must conform to the orders passed by the Prescribed Authority under Section 25 of the Societies Registration Act. 3. In cases where the committee of management of a society and the committee of management of an educational institution run by that society are the same, the decision of the Prescribed Authority under Section 25 of the Societies Registration Act prevails over the decisions of the BSA and the Registrar. 4. The Hindu College case, which dealt with an Intermediate College under the Intermediate Education Act, is distinguishable from cases involving Basic Schools under the Societies Registration Act. The provisions and principles governing Intermediate Colleges do not apply to Basic Schools.

Final Decision: 1. The order of the AR dated 30/10/1999 recognizing Sri Satya Pal Singh as the manager was quashed, and the AR was directed to refer the dispute to the Prescribed Authority within two weeks. The Prescribed Authority was directed to decide the case expeditiously, if possible within six months. 2. The order of the BSA dated 5/04/1999 recognizing Sri Satya Pal Singh as the manager was upheld, subject to the decision of the Prescribed Authority. 3. The order of the BSA dated 23/10/1999 for single operation of accounts was quashed as it was passed without affording reasonable opportunity to the committee of management.
