Honble V.K. Shukla, J.—Present writ petition has been filed by the petitioners for quashing of the order dated 12.12.2007 by means of which petitioners have been transferred from Civil Police to Armed Police by the Senior Superintendent of Police, Lucknow after taking due permission from Inspector General of Police, Lucknow.
2. Contention of the petitioners is that their transfer is in breach of Regulation 525 of U.P. Police Regulations as they have completed more than ten years services as Constable Civil Police, in this background they could not have been transferred.
3. This fact has not been disputed in the counter-affidavit filed on behalf of State respondents that petitioners have completed more than ten years of service in Civil Police.
4. Honble Apex Court in the case of Jasveer Singh v. State of U.P. and others, in Special Leave to Appeal (Civil) Nos. 6853 of 2004 has taken following view which is being quoted below :
