Headnote:Pension—Pensionary benefits—Petitioner was appointed on 3-9-1981 and was regularized w.e.f. 6-10-1997—Worked for more than 6 years and 26 days—He was accorded appointment on temporary basis and functioned till he attained the age of superannuation—He was entitled to receive pension in view of amendment of Rule 56 by U.P. Act No. 24 of 1975—Hence, temporary service rendered by petitioner cannot be permitted to be ignored and the same has to be clubbed for purposes of computation of qualifying service for pension purpose—Respondents directed to release pension of petitioner. [U.P. Fundamental Rules—Rule 56(e)].
