Headnote:Criminal Procedure Code, 1973—Section 439(1)—Bail—Offence under Sections 498-A, 304-B, IPC and Section 3/4 of Dowry Prohibition Act—Cause of deceased death was asphyxia as a result of hanging—Deceased was under medical treatment under various medical doctors—No external injury over body of deceased except ligature marks—At time of inquest, parental relatives of deceased were present on spot—They did not made any complaint regarding demand of dowry—Husband applicant was getting deceased treated from various doctors—This fact that the deceased was under medical treatment was suppressed by prosecution—Applicant deserves to be released on bail.
