Headnote:Habeas Corpus Petition—Detention—Confinement—Petitioner confined in Nari Niketan by order passed by CJM—Revision against—Dismissal of—It was found that lady was aged about 18 years—Her statement recorded under Section 164 of Cr.P.C.—Victim of offence under Sections 363, 366-A, 366 or 376 of IPC not falling in category of accused—Even protective custody of such lady not justified if she object to it—It is contrary to constitutional mandate—Personal liberty is fundamental right irrespective of age of person—Hence, detention/confinement of petitioner is illegal/wrongful.

       Petition Allowed.
