Headnote:

Section 482 Cr.P.C. - Quashing of Criminal Proceedings - Prima Facie Case

Fact of the Case:

The applicants sought to quash the order of the lower court which had rejected the final report and taken cognizance of certain offences against the applicants. They contended that no offence was disclosed and the prosecution was instituted with a malafide intention.

Finding of the Court:

The court held that at the current stage, it cannot be determined that no offence is made out against the applicant. It emphasized that only a prima facie case is to be seen at this stage, and the disputed questions of fact cannot be adjudicated upon under Section 482 Cr.P.C. The prayer for quashing the proceedings was refused, but the applicants were given the opportunity to apply for bail within 45 days and were granted protection from coercive action during this period.

Issues: The main issue was whether the court should quash the criminal proceedings against the applicants based on the contention that no offence was disclosed and the prosecution was instituted with a malafide intention.

Ratio Decidendi: The court relied on the law laid down by the Supreme Court in cases of R.P. Kapur Vs. State of Punjab, State of Haryana Vs. Bhajan Lal, State of Bihar Vs. P.P.Sharma, and Zandu Pharmaceutical Works Ltd. Vs. Mohd. Saraful Haq to emphasize that only a prima facie case is to be seen at the initial stage.
