2. Learned counsel for the parties are present.
3. Shri Gulrez Khan, holding brief for Shri J.H. Khan, learned counsel for the Plaintiff/Appellant in the Appeal and learned counsel for the Applicant in Civil Misc. Contempt Application No. 48063 of 2011 states that the Plaintiff/Appellant does not want to pursue the present Appeal any further, and he wants to withdraw the same and, therefore, the present Appeal may be dismissed as withdrawn.
4. Civil Misc Withdrawal Application No. 263537 of 2012 has also been filed on behalf of the Plaintiff/Appellant making similar prayer.
5. The aforesaid Withdrawal Application is supported by an Affidavit sworn by Dinesh Kumar ( Plaintiff/Appellant) on 5.9.2012.
6. Shri Adil Jamal holding brief for Shri Jamal Ali, learned counsel for the Defendant/Respondent Nos. 1 and 2 and Shri Rakesh Kumar, learned counsel for the Defendant/Respondent Nos. 5 and 6 have no objection to the prayer made on behalf of the Plaintiff/Appellant being granted.
