Headnote:

Section 482 Cr.P.C. - Quashing of Charge Sheet - Prima Facie Case - Disputed Questions of Fact

Fact of the Case:

The applicants filed an application under Section 482 Cr.P.C. seeking to quash the charge sheet against them, claiming that no offence was disclosed and the prosecution was instituted with a malafide intention.

Finding of the Court:

The court found that at this stage, it cannot be said that no offence is made out against the applicants. It held that only a prima facie case is to be seen at this stage and the disputed questions of fact cannot be adjudicated upon under Section 482 Cr.P.C.

Issues: The main issue was whether the charge sheet against the applicants should be quashed based on the contention that no offence was disclosed and the prosecution was instituted with a malafide intention.

Ratio Decidendi: The court relied on the law laid down by the Supreme Court in cases of R.P. Kapur Vs. State of Punjab, State of Haryana Vs. Bhajan Lal, State of Bihar Vs. P.P.Sharma, and Zandu Pharmaceutical Works Ltd. Vs. Mohd. Saraful Haq to emphasize that only a prima facie case is to be seen at the initial stage.

Final Decision: The court refused the prayer for quashing the proceedings and the chargesheet, but directed that if the applicants appear and surrender within 45 days and apply for bail, their prayer for bail shall be considered and decided.
