ASHWANI KUMAR MISHRA
Ram Samujh – Appellant
Versus
State Of U. P. – Respondent

Advocates:
Advocate Appeared:
For the Appellant : Yashodanand Shukla
For the Respondent: Narendra Kumar Tiwari

JUDGMENT :

1. Heard learned counsel for the petitioner, Sri Vikram Bahadur Yadav learned Standing Counsel for the respondent no.1 and Sri Devesh Vikram for the respondent nos.2 and 3.

2. It appears that petitioner's claim for release of pension and other retiral benefits is pending consideration before the respondent no.3. It is not in issue that petitioner has superannuated on 30.4.2019.

3. In such circumstances, it would be appropriate to call upon the second respondent to examine petitioner's claim for release of pension and other retiral benefits, in accordance with law, by passing a reasoned order, within a period of three months from the date of presentation of a copy of this order. All consequential action shall be taken without further loss of time.

4. With the above observations/directions, this writ petition stands disposed of.

5. The concerned Authority/Official shall verify the authenticity of computerized copy of this order from the official website of High Court Allahabad and shall act accordingly without waiting for submission of the certified copy of this order.
