Finding of the court: Petition by giving opportunity to petitioner to file a representation in respect of her claim, by annexing copy of previous representation, before respondent no. 2-District Magistrate. If such representation is filed within three weeks from today, same shall be addressed and decided in accordance with law, preferably, within eight weeks from date of filing of such representation.

Result: Petition disposed of

ORDER :

1. The prayer in this petition is to command the respondent no. 2 to decide the claim of the petitioner under Mukhyamantri Kisan Evam Sarvhit Beema Yojana.

2. It appears from the record that the claim of the petitioner was rejected by the Insurance Company.

3. As the District Level Committee, whose Chairperson is the District Magistrate of the district concerned, is the apex body of the district for deciding the claim under the Yojana, we deem it appropriate to dispose off the petition by giving opportunity to petitioner to file a representation in respect of her claim, by annexing copy of the previous representation, before the respondent no. 2-District Magistrate, Jaunpur. If such representation is filed within three weeks from today, the same shall be addressed and decided in accordance with law, preferably, within eight weeks from the date of filing of such representation.

4. It is expected that the decision taken by the District Level Committee would be after giving opportunity to the parties including the insurance company concerned.

5. It is made clear that we have not expressed any opinion on the merits of the claim of the petitioner.
