JUDGMENT :

1. This writ petition has been filed by the petitioner with the following prayers:

    “a). Issue a writ, order or direction in the nature of certiorari quashing the impugned order dated 16.11.2006 passed by respondent no. 2 (Annexure No. 15 to this writ petition).

(b). Issue a writ, order or direction in the nature of mandamus, commanding the respondents to consider the claim of petitioner for compassionate appointment afresh and appoint the petitioner on a suitable class IV post, under the Dying in Harness Rules within some stipulated period, as this Hon'ble Court may deem fit and proper,

(c). Issue any other writ, order or direction as this Hon'ble Court may deem fit and proper in the circumstances of the present case.

(d). Award cost to the present writ petition to the petitioner.”

2. Learned counsel for the petitioner argued that the father of the petitioner who was a permanent class IV employee in the department of respondents, left his home on 01.05.1996 at about 6.00 P.M. for night duty and did not return to his home till 08.05.1996.
