Headnote:

Protection – Government Order - Petitioner submits that grievance raised in present writ petition has already been adjudicated by this Court vide judgment delivered in Writ Petition. It is prayed that similar protection be granted to present petitioner also - Held, The concerned Court/Authority/Official shall verify authenticity of such computerized copy of the order from the official website of High Court Allahabad and shall make a declaration of such verification in writing - Writ petition is disposed of.

JUDGMENT :

1. Shri Man Mohan Singh, learned counsel for the petitioner submits that the grievance raised in the present writ petition has already been adjudicated by this Court vide judgment delivered on 13.2.2019 in Writ Petition No. 26100 of 2018 ( Dr. Gangesh Dixit and others Vs. State of U.P. and others). It is prayed that similar protection be granted to the present petitioner also.

2. Learned Standing Counsel, appearing for the State however submits that individual case will have to be examined to ascertain as to whether claim of the petitioner is covered by that adjudication made in Dr. Gangesh Dixit (supra). It is also urged that facts could have to be verified regarding continuance of petitioner under Government Order dated 7.4.1998 on honorarium basis.

3. It goes without saying that the authorities of the State would be at liberty to examine individual facts of writ petitioner. The ratio of law laid down by this Court in Dr. Gangesh Dixit would determine the claim of the present petitioner also if his case is identical on facts. The required consideration would be made by passing a reasoned order within a period of three months from the date of production of a computer generated copy of this order, downloaded from the official website of the High Court Allahabad.

4. The computer generated copy of such order shall be self attested by the party concerned. The concerned Court/Authority/Official shall verify the authenticity of such computerized copy of the order from the official website of High Court Allahabad and shall make a declaration of such verification in writing.

5. The writ petition is disposed of.
