2000 Supreme(UK) 5

UTT ARANCHAL HIGH COURT
HON'BLE A.C.J. & P.C. VERMA, J.
Virendra Smgh ...Appellant
versus
State of U.P. ...Respondent
Criminal Misc. Ball Application No. 16583 of 2000
Decided on : 10-11-2000

The main legal point established in the judgment is that the court granted bail based on the lack of prima facie evidence to implicate the accused for the offence of murder under Section 306 IPC.

Headnote:

306 IPC - Bail Application - The court found that there was no prima facie evidence to implicate the accused for the offence of murder under Section 306 IPC and granted bail based on the lack of evidence.

Fact of the Case:

The applicant was facing prosecution for the offence punishable under Section 306 I.P.C, with prima facie allegations of committing murder of his wife.

Finding of the Court:

The court analyzed the post mortem report and found that it did not disclose the cause of death. As there was no prima facie evidence to implicate the accused, the court concluded that the applicant deserved to be released on bail.

Issues: The main issue was whether there was sufficient evidence to implicate the accused for the offence of murder under Section 306 IPC.

Ratio Decidendi: The court's decision was influenced by the lack of prima facie evidence to implicate the accused for the offence for which he had been charged.

Final Decision: The applicant was released on bail in the case under Section 306 IPC.
