Heard Sri Manoj Sah, learned counsel for the petitioner, and Sri Ranjan Ghildiyal, learned Brief Holder appearing on behalf of the State Government.

2. The challenge, in this writ petition, is to the order passed by the Uttarakhand Public Services Tribunal, Dehradun in Claim Petition No. 31/DB/2013 dated 08.08.2014.

3. Facts, to the limited extent necessary, are that the petitioner was transferred from Saharanpur to Pauri on 02.12.1998, and was relieved of his duties, as a Constable at Saharanpur, on 31.12.1998 to join at Pauri. The petitioner, however, chose not to join at his new place of posting. For his absence from duty, he was placed under suspension with effect from 16.02.1999, and was directed to be present at Pauri. A disciplinary inquiry was conducted against the petitioner, and the punishment of dismissal from service was imposed on him on 01.07.2000. Aggrieved by the order of dismissal, the petitioner preferred an appeal which was also rejected by order dated 02.11.2000. Questioning both the orders, the petitioner invoked the jurisdiction of this Court filing Writ Petition (S/B) No. 843 of 2001, which was dismissed by order dated 05.05.2008
