1. Invoking the revisional jurisdiction of this Court under Section 115 of the Code of Civil Procedure (in short 'the Code') the petitioner/defendant No. 2 has called in question the justifiability of the order dated 7-4-1999 passed by the learned IIIrd Additional District Judge, Raipur in Misc. Civil Appeal No. 41/98.

2. The facts as have unfolded are that the non-applicant No. 2 as plaintiff initiated civil action being Civil Suit No. 70-A/91 for the following reliefs :--
